New Delhi: A consumer forum on Saturday held Nokia India Private Limited (NIPL) guilty of "unfair trade practice and deficiency in service".

The order came after Delhi-based Sameer Sharma filed a complaint that the mobile phone manufacturer had replaced his original handset, which had battery problem, with an "old and refurbished" instrument.

"NIPL indulged in unfair trade practice in replacing the defective handset with an old refurbished set which too did not function properly," the Forum, comprising President S L Khanna and Member S R Agrawal, said in a recent order.

The South-West District Forum directed the company to pay Rs 22,000, including the cost of the phone, to Sharma.

The consumer forum also observed that "the complainant was justified in losing confidence in the product of NIPL as after spending a huge sum he purchased the set but was saddled with a defective one".

Sharma had purchased a Nokia 6681 mobile phone in September last year. But when he found that the mobile phone had a low battery backup, he approached NIPL office in Mahipalpur area of Delhi.

On the advise of the dealer, he deposited the handset with on September 22. After a number of visits, Sharma was then given another set, which he found to be an old and refurbished one.

Despite repeated requests for replacing the defective handset with a new one, NIPL did not take any action. It was then that he decided to approach the Forum asking for the refund of cost.
