New Delhi: The Metropolitan Magistrate's Court in Delhi's Saket has taken cognisance of the chargesheet filed by Delhi Police against five accused in the barbarous gangrape and murder of a 23-year-old paramedical student. After taking cognizance of the chargesheet the court summoned the five accused on January 7 at 12:30 pm. The trial will take place in the designated fast-track court in Saket and the braveheart will be known as XYZ so as to protect her identity.
"I have perused the charge sheet and other documents. Prima facie offence under sections, 302 (murder), 307 (attempt to murder), 376 (2)(g) (gangrape), 377 (unnatural offences), 395 (dacoity), 396 (murder in dacoity), 394 (hurting in dacoity), 201 (destruction of evidence), 120B (conspiracy), 34 (common intention) and 412 (dishonestly receiving stolen property) of the IPC is made out against all the accused. I take cognisance of the charge sheet and issue summons/production warrants to all the five accused for January 7," Metropolitan Magistrate Namrita Aggarwal said. The five accused are Ram Singh, Mukesh Singh, Vinay Sharma, Pawan Gupta and Akshay Singh Thakur.
The chargesheet, which runs into 1000 pages, was on Thursday filed against five accused, who have been charged with murder, rape and abduction among other charges. The trial in the case will be in-camera and no public would be allowed during the proceeding.
Delhi Police have also moved an application before the Juvenile Justice Board for verification of the minor accused in the gangrape and murder of a 23-year-age paramedical student. The juvenile board has summoned the school principal of the minor accused, who claims to be 17 years old.
The statement given by the braveheart to the Sub-Divisional Magistrate, while she was undergoing treatment at Safdarjung Hospital in the national capital, and by her friend are slated to be the key evidence to nail the six accused in the barbaric case.
The juvenile's case will be heard on January 7, said Delhi Police Joint Commissioner Vivek Gogia on Saturday. All the six who had gangraped and then murderously assaulted the 23-year-old paramedical student have been charged with murder following the death of the girl at a Singapore hospital early on Saturday morning. All of them have been arrested and five of them, who are above the age of 18 years, sent to Tihar Jail while the sixth accused has been sent to a judicial remand home as he has claimed that he is a minor.
The hearing in the gangrape case will take place on a day-to-day basis with no adjournments at a fast-track court, which was inaugurated by Chief Justice of India at Saket on Wednesday. The prosecution has said that it will try to finish the trial in a month even as the Saket District Court Bar Association on Wednesday passed a resolution saying none of the lawyers would defend any of the accused in the brutal gangrape case.
The six accused are Ram Singh, Mukesh Singh, Vinay Sharma, Pawan Gupta, Akshay Singh Thakur and a boy claiming to be minor. Ram Singh used to drive the bus inside which the girl was raped and beaten up with an iron rod along with her male friend who tried to save her. Ram Singh is the main accused in the case and Mukesh is his brother and used to work as a cleaner.
Vinay Sharma is an assistant gym instructor and Pawan Gupta is a fruit seller. The bus in which the horrific crime was committed was tracked down to Delhi's RK Puram, Sector 3. While Ram Singh was arrested from RK Puram, his brother Mukesh was arrested from Rajasthan. Vinay Sharma and Pawan Gupta were also arrested from RK Puram. Akshay Singh alias Thakur was tracked to Bihar and arrested while the minor accused was arrested from his native place in Uttar Pradesh.
All the accused have been charged under Indian Penal Code Sections 395 (dacoity) (imprisonment for life or rigorous imprisonment and fine), 377 (sodomy or unnatural sex) (imprisonment for life or upto 10 years and fine) 376(2)(G) (gangrape) (rigorous imprisonment from minimum 10 years to life and fine), 302 (murder) (death or imprisonment for life and fine), 201 (destruction of evidence) (imprisonment upto 7 years and fine).
On the fateful night of December 16 the girl and her male friend had watched a movie and then while returning home boarded a private bus, after being told by the accused that it would drop them near their residence.
Both the girl and her male friend, who had boarded the chartered bus with tinted glass windows from Munirka to Palam around 9.45 PM on December 16, were assaulted with an iron rod by the men after the two resisted. The girl was then raped by the six accused before she and her friend was dumped on the road side near Mahipalpur flyover.
