The High Court on Friday ordered issuance of notices to the BBMP and others following a PIL filed alleging the BBMP of permitting unauthorised constructions in and the city.
Petitioner S P Vijay Kumar stated that the palike has permitted illegal constructions in an unauthorised layout-Krishna Reddy Layout in Bommanahalli.
He said, “The builder is permitted to violate the law by constructing four floors for residential purpose, which is being used for commercial purpose. The Palike has failed to take action in terms of Section 300 of the KMC Act.” He added the palike permits construction of these buildings by issuing ‘B’ Khathas.
He said that BESCOM and BWSSB provide illegal connections to such buildings which are approved by the Town and Country Planning authorities. The BMTF has also failed to take action.
Hearing the petition a division bench comprising Chief Justice Vikramjit Sen and Justice B V Nagarathan issued notice to UDD, commissioner and assistant Director (town planning) of the BBMP, BWSSB, BESCOM and others and adjourned the petition.
