New Delhi: Ishrat Jahan's family has filed a petition in the Supreme Court on Thursday, challenging Gujarat High Court's judgement.
The High Court had stayed action based on S P Tamang's inquiry report, which had busted the body of lies that Ishrat and her friends were members of Laskhar-e-Toiba and that they plotted to kill Gujarat Chief Minister Narendra Modi.
The report had concluded that Ishrat and her friends were gunned down by Gujarat Police in a fake encounter in 2004.
The High Court on September 9 stayed implementation of the magisterial report which blamed the Gujarat Police for faking the encounter of Ishrat Jahan and three of her friends in June 2005.
The High Court came down on Justice Tamang - who submitted the report on the fake encounter - saying: "The Metropolitan Magistrate should have submitted the report to Gujarat High Court instead of publishing it and it was beyond the Magistrate's jurisdiction to hold the police guilty in the case. The Registrar General should take appropriate action in accordance with the law."
Gujarat HC has also banned any further publication of this report.
Going a step further, the High Court is also suggesting action against Magistrate Tamang for making his report public.
