New Delhi: Abu Salem's lawyer, Ashok Sarogi, claimed on Thursday that Portugal has issued a notice to India about alleged violations of provisions of the extradition treaty under which Salem was sent to India to stand trial.
Sarogi says that the act of torture and forced confession flout the provisions of the extradition treaty as they relate to use of coercion and cruelty against Salem.
Salem's other lawyer, Oves Siddiqui, is to file an application in the TADA court at 1430 (IST) on Friday. The application is to appeal that Salem be removed from police custody and transferred to judicial custody or one of his lawyers XXXX to be present during interrogation.
Meanwhile, Salem's lawyers say if the CBI did not mend its ways and continues to violate the extradition treaty, then they may have to move to Portugal Court, seeking that Salem be called back.
