New Delhi: Urging a Delhi court to take cognizance of the chargesheet filed in the Sunanda Pushkar death case, the Delhi Police cited a poem written by the deceased while levelling charges of abetment to suicide and cruelty against her husband and Congress MP Shashi Tharoor.
Heading a special court to try lawmakers, Additional Chief Metropolitan Magistrate Samar Vishal reserved his order on whether it would take cognizance of the chargesheet filed by the Delhi Police. The order would be delivered on June 5.
Atul Kumar Srivastava, the Additional Public Prosecutor appearing for Delhi Police, submitted that Sunanda had e-mailed a poem to Tharoor on January 5, just a few weeks before she was found dead in the room of a 5-star hotel in the national capital.
"’I don't care about test, I don't have will to live, All I pray for is death’ is the mail that Sunanda wrote to Shashi Tharoor," said the Delhi Police counsel.
The poem, mentioned in page 270 of the chargesheet, is the first direct evidence from Sunanda presented by the Delhi Police against Tharoor.
The Additional Public Prosecutor also submitted that "Sunanda Pushkar had ante mortem injuries on her body which is reflected on her post mortem too. When she was hospitalized, she had high fever and cannula."
The Delhi Police have based the chargesheet on abetment to suicide and cruelty.
The 3,000-page chargesheet has key sections like Section 113A of the Indian Evidence Act, Sections 498 A (husband or his relative subjecting a woman to cruelty) and 306 (abetment of suicide) of the Indian Penal Code.
Tharoor has termed the chargesheet as “preposterous” and said that he intended to “contest it vigorously”.
"No one who knew Sunanda believes she would ever have committed suicide, let alone abetment on my part. If this is conclusion arrived at after 4+ years of investigation it does not speak well of the methods or motivations of the Delhi Police,” he said.
