False affidavit case against Jayalakshmi postponed to October 15

The Judicial First Class Magistrate Court, Mananthavadi, on Thursday postponed the false affidavit case against Minister for Welfare of Scheduled Tribes and Youth Affairs P K Jayalakshmi to October 15.

A criminal offence case was filed against the minister for submitting ‘false information in the affidavit’ filed along with the nomination paper for the previous Assembly elections.

According to a petition filed in public interest by DYFI Sulthan Bathery village committee secretary K P Jeevan, the minister, representing the Mananthavadi Assembly constituency, had concealed facts while submitting the election expenditure details with the returning officer. Taking up the petition, the court demanded additional evidence and added that a more complete presentation of the facts is required.

According to the complainant, Jayalakshmi had failed to furnish the details of a sum of `10,00,000 which she received through her account number 20052376881 with the State Bank of India, Mananthavadi branch, soon after filing the nomination paper. She withdrew the full amount over nine times before the election, he alleged.

As per the election spending returns submitted by Jayalakshmi to the returning officer, the expenditure stood at `3,91,584.  Meanwhile, the court dismissed the petition with regard to the alleged discrepancies in her educational qualification in the affidavit.

She had submitted that her qualification comprises a degree from the Kannur University and a diploma in Computer Application, but the petition filed by the litigant stated that she did not hold a university degree. Advocate C S Hrithwik appeared on behalf of the petitioner.
