Giving the benefit of doubt, the Madras High Court had ordered the acquittal of a man and his paramour from a murder case. “We are coming to the irresistable conclusion that the prosecution has not proved its case beyond all reasonable doubts. Thus, the findings of the trial court are required to be unseated,” a division bench consisting of Justices KN Basha and P Devadass said on August 3.
The bench was allowing a criminal appeal from Chinnapillai and Annamalai challenging the orders of the Additional Sessions Judge inKrishnagiri awarding life imprisonment to them in November, 2010.
According to prosecution, Chinnapillai (wife of Rajendran) Annamalai (her neighbour) killed Rajendran, when he noticed them in a compromising position on September 6, 2008. The lower court awarded life term to the duo.Allowing their appeal, the bench said that none of the circumstances projected by the prosecution had been established.
