Mumbai: The Naval authorities on Tuesday told the High Court that they have given a "clean chit" to a serving official against whom the allegations of rape were levelled by the wife of a senior sailor attached with the Naval Police branch in Mumbai.
A division bench of Justice A M Khanwilkar and Justice AR Joshi was hearing a petition filed by the woman stating that she was raped twice by Regulating Petty Officer Jitendra Singh on July 30, 2010 and August 6, 2010 at New Navy Nagar in Colaba.
The complainant alleged that Singh sexually assaulted her at gun point when her husband was away on temporary duty to Delhi.
She had requested the high court through a petition to direct the local police to investigate the charge, following which the court on last hearing asked the naval authorities to file a reply on the matter.
In the affidavit filed on Tuesday by Commanding Officer of INS Angre, Neeraj Joshi stated that the allegation of rape was "uncorroborated and unreliable".
Even additional public prosecutor A S Gadkari submitted that prima facie it appeared a case of consensual sex.
Following this, the court disposed of the petition and directed the naval authorities to provide the petitioner a copy of their investigation report.
