The Lokayukta Court on Monday posted for orders to October 4 a case filed against former prime minister H D Deve Gowda and four former chief ministers, for “helping” alleged land grabbing by Nandi Infrastructure Corridor Enterprises (NICE) in the Bangalore-Mysore corridor project.
The main contention of the complainant, T J Abraham, was that NICE floated the project in collusion with the political leadership of the time, with the sole intention of grabbing land in and around Bangalore.
To see the implications of the case, the Lokayukta Court dealt with some cases involving NICE project that came up before the Karnataka High Court and the Supreme Court, which discussed the contractual capacity of the government in sanctioning the project.
In November 1997, H T Somashekar Reddy, a retired chief engineer with the Public Works Department, contended in a Public Interest Litigation petition filed in the High Court that the project was opposed to public policy.
However, in 1998, the High Court upheld the validity of the framework agreement and ruled that the objective of the state in entering into the contract was not to fritter away assets or to augment revenue as alleged.
T J Abraham, however, argued that Somashekar Reddy was a party to the whole scam and misrepresented the facts and mentioned the project area as 20,193 acres instead of 18,313 acres. And with the High Court upholding the contention, the misrepresented figures were justified by NICE in all other cases, Abraham alleged.
