RG Kar rape and murder accused Sanjay Roy may have claimed in court on Tuesday that he was innocent, but the Central Bureau of Investigation (CBI) charge sheet seen by CNN-News18 has enough evidence to nail Roy and prove his guilt.

The agency, in its first charge sheet in the case, has cited material, technical and scientific evidence to hold Roy guilty of the rape and murder of the 31-year-old trainee doctor at the hospital.

Scientific evidence

The DNA profiling report cited by CBI shows that Roy’s saliva was found on the body of the victim. “The nipple swab shows presence of his saliva,” CBI says. It adds that Roy’s DNA was also found on the material collected from under the nail of the victim. A ‘short hair’ found at the scene of crime also belongs to Roy,” the charge sheet says. Roy’s DNA also matched with samples collected from the deceased’s body. Apart from this, the blood stains of the victim have been found on the jeans and footwear of the accused. He is seen wearing the same clothes in the CCTV footage. Kolkata Police had recovered his clothes from the barrack of 4th Kolkata armed police where Roy resided.

Technical evidence

The mobile tower location proves Roy’s presence at RG Kar Hospital between 3.30 and 4am on August 9. As per the autopsy report, the deceased was killed around the time.

The CCTV cameras have also captured Roy entering the hospital around this time as well as on the third floor of the building where the seminar hall — the scene of crime — is located. “He is seen entering the hospital, waving to the security guard and then exiting the trauma center. He is again spotted at 4.03 hours on August 9, moving from the right side of the camera towards the ward on third floor. At 4.31, the accused moves towards the camera, turns around and goes back towards the ward. At 4.32am, he is seen holding a helmet in his left hand without his Bluetooth neckband and then he moves towards the right of the camera,” CBI says.

Material Evidence

Roy, as per CBI, is seen entering RG Kar wearing a Bluetooth band around his neck. The CCTV camera, however, captures him leaving without it. A Bluetooth band found at the scene of the crime matched with what was seen on camera. CBI says it also paired with the mobile device of the civic volunteer.

Multi-doctor Team Consulted

CBI said before filing its charge sheet, it consulted a specialist team of doctors to examine the evidence. “A multi-institutional medical board (MIMB) comprising expert members from AIIMs, RML, Lady Hardinge, Vardhaman Mahavir Medical College, Safdarjung Hospital, and Maulana Azad Medical College under the chairmanship of AIIMS’ forensic medicine professor who gave medico-legal opinion on the case,” the agency said.

The doctors, as per the charge sheet, were of the opinion that the victim died because of asphyxia and was subjected to sexual assault 12 hours before post mortem.

The doctors also said the magisterial inquest report was consistent with the post-mortem report. This is a significant finding since questions have been raised if the post-mortem process itself was vitiated.

The MIMB, CBI said, also considered the injuries on Roy and opined that these are blunt-force injuries “consistent with resistance/struggle by the victim”. The agency, however, told the court that the final report of the MIMB is awaited.

The agency believes that Roy’s motive was to sexually assault the doctor and she was killed while resisting him. CBI has also said it is investigating former RG Kar principal Sandip Ghosh and officer-in-charge of Tala police station Abhijeet Mondal on charges of destruction of evidence.
