A man gave triple talaq to his wife over WhatsApp after she told him that she donated a kidney to her sick brother. The wife lives in Uttar Pradesh’s Bairiyahi while her husband lives in Saudi Arabia.
Unaware of the fact that her decision to save her brother would be at the cost of her marriage, the wife donated her kidney to the ailing brother, NDTV reported.
The husband, as soon as he received a message about the kidney donation, gave his wife triple talaq.
Following this, the woman filed a complaint with the police, based on which they registered a case and assured her that legal action will be taken.
In a similar incident in November, a man reportedly divorced his wife in UP’s Kanpur over video call after he saw that she got her eyebrows shaped without his permission.
He allegedly uttered the word ‘talaq’ thrice over the call from Saudi Arabia. The incident, which occurred on October 4, came to light after the woman named — Gulsaiba — filed a police complaint.
The Triple Talaq law, enforced by the National Democratic Alliance (NDA) government on August 1, 2019, classified giving ‘instant divorce’ by Muslim men to their wives as a criminal offence.
The law prescribes a three-year jail term for a man divorcing his wife through triple talaq. Arrests can be made without a warrant, and a bail is given only at the discretion of a magistrate.
The Supreme Court termed the practice of ‘triple talaq’ as “void”, “illegal” and “unconstitutional”.
“Triple talaq”, or talqa-e-biddah as its known among Muslim communities, is a practice which gives a man the right to divorce his wife by uttering ‘talaq’ three times in one sitting, in any form including email or text message, without his wife’s consent.
