BANGALORE: The High Court on Thursday dismissed a writ appeal filed by 13 members of the Mandya City Municipal Council (CMC) challenging their disqualification after election for bringing in no confidence motion against their own President.Hearing a petition filed by Byrappa and 12 others who have moved the High Court challenging the Mandya DC order to disqualify them after a complaint by JD (S), the party under which they were elected, the division bench comprising Justice Manjula Chellur and Justice Venugopala Gowda upheld the contention of Additional Advocate General’s contention that dissent in party forum is permissible but not the defection. The petitioners had moved a no confidence motion against the chairman of the council Nagamma, who happened to be their own party member by forming a group which later led to their disqualification. The disqualification was challenged by the petitioners in the High Court which was upheld by Justice H N Nagamohan Das, who cited various Apex Court judgments and observed,  “Even if one third members form a separate group, they will be still disqualified. Defection is a great curse to Parliamentary system of Government and once elected by a political party, they have to stay with them or resign.”The petitioners appealed before the division bench which upheld the order.
