The Supreme Court on Monday unanimously upheld the Centre's decision to abrogate Article 370 of the Constitution that bestowed special status upon the erstwhile state of Jammu and Kashmir, ordered restoration of statehood "at the earliest" and set a September 30, 2024 deadline for holding the assembly elections

Hailing the Supreme Court (SC) verdict upholding the abrogation of Article 370 in Jammu and Kashmir (J&K), the Muslim Students’ Organisation and All India Sufi Sajjadanashin Council said it will help the Muslim youth in the Valley.

In a statement, the Muslim Student’s Organisation said: “This is a welcome move. We hope this will help Muslim youth. We expect the Muslim youth to stay away from Muslim politics done by most political parties.”

The organization added that Article 370 was harmful for Muslims of Kashmir and now time has come for development.

Hazrat Syed Naseruddin Chishty, successor of Spiritual Head of Ajmer Dargah & Chairman of All India Sufi Sajjadanashin Council said, “The whole nation stands in ovation for this historic judgment. The hon’ble Supreme Court kept its reputation as the best interpreter of the Constitution. The judgment further reposed the trust and faith of the people of India in our Judiciary.”

He added: “Where there is a will, there is a way. Strong will is needed for a strong decision by a strong and powerful leader to make the country and its people strong and united. Hats off to Amit Shah ji and government of India under the leadership of PM Modi ji for making our country strong and united. History will remember this as a historic moment.”

THE SC VERDICT

The Supreme Court on Monday unanimously upheld the Centre’s decision to abrogate Article 370 of the Constitution that bestowed special status upon the erstwhile state of Jammu and Kashmir, ordered restoration of statehood “at the earliest” and set a September 30, 2024 deadline for holding the assembly elections.

Settling the decades-long debate over the vexed constitutional provision, a five-judge constitution bench headed by Chief Justice D Y Chandrachud delivered three concurring judgements upholding abrogation of Article 370 that provided a unique status to Jammu and Kashmir when it acceded to the Union of India in 1947.

The Supreme Court verdict is a “resounding declaration of hope, progress, unity for our sisters and brothers in J&K, Ladakh,” Prime Minister Narendra Modi, who spearheaded the move as part of the ruling BJP’s long-standing promise, said. Writing the judgement for himself and Justices B R Gavai and Surya Kant, CJI Chandrachud ruled that Article 370 was a temporary provision and the President of India was empowered to revoke it in the absence of the Constituent Assembly of the erstwhile state whose term expired in 1957.

The apex court also upheld the validity of the union government’s decision to carve out the union territory of Ladakh from the erstwhile state of Jammu and Kashmir. “We direct that steps shall be taken by the Election Commission to conduct elections to the Legislative Assembly of Jammu and Kashmir constituted under Section 14 of the Reorganisation Act by September 30, 2024. Restoration of statehood shall take place at the earliest…,” the CJI said.
