New Delhi: Refusing to go into the details what constitutes to be considered hate speeches, the Supreme Court has referred the matter to the Law Commission of India to look into the question of hate speeches.
In 2013, there was a petition by the Pravasi Bharti Sangathan in the apex court that raised a question that politicians were using hate speeches which is in violation of the Constitution. The plea had requested the court to lay some guidelines to prevent the politicians from using derogatory language.
The PIL by the Pravasi Bharti Sangathan submitted that speeches targeting religion, region, caste or place of birth were against the provisions of the Constitution. The bench has also sought response from the Election Commission on the issue.
