New Delhi: The Supreme Court on Tuesday will decide on Section 377 of the IPC, which will empower law to take punitive measures against those indulge in consensual sexual acts of Lesbian, Gay, Bi-sexual and Transgender (LGBT) adults.
Meanwhile, a day before the SC's ruling on Section 377 which makes gay sex a crime, the LGBT community steps up pressure to decriminalize homosexuality with vigils across the country.
The LGBT community has been fighting to decriminalize homosexuality for more than 15 years. Tomorrow it will be the last legal recourse for those who want to scrap section 377.
Legal experts claimed that courts usually grant curative petitions in rare and exceptional cases. Earlier, SC refused to decriminalize homosexuality and now it will once again re-examine the 2013 judgment upholding the constitutional validity of Section 377.
The struggle for gay rights begun in 2001 and their movement intensified in 2009. The Delhi High Court in a landmark ruling in 2009 declared that Section 377 violated Articles 21, 14 and 15 of the Constitution.
However, their victory was short lived after SC challenged the HC's decision. In January 2014, the apex court dismissed a bunch of review petitions against its verdict.
Despite setbacks, the LGBT community decided to go ahead with their movement by organizing public events to sensitize society about their rights.
The petitions - filed by parents, civil society, scientific and LGBT rights organizations - will be heard by senior judges including T.S. Thakur, Justices Anil R. Dave and J.S. Khehar.
