26-Week Pregnancy Case: Supreme Court Rejects Woman's Plea For Termination

The Supreme Court on Monday rejected a woman’s plea to terminate her over 26-week pregnancy on account of her illness. “Medical termination of pregnancy cannot be allowed,” CJI DY Chandrachud said while delivering the verdict.

“The State is directed to bear all medical costs. The court has clarified that it is up to the mother to give up the child for adoption or not,” CJI further said.

Earlier, the Apex Court reserved its order on the plea of the married woman who sought termination of her over 26-week healthy foetus on account of her illness.

A bench comprising of Justices JB Pardiwala and Manoj Misa and headed by Chief Justice DY Chandrachud noted that the fresh report from the AIIMS medical board confirmed that the petitioner is suffering from post-partum psychosis and the foetus hasn’t been affected by her medication.

“Okay, we will look into it. The judgement may come out later today,” the bench said.

Earlier on Friday, the Supreme Court sought a report from the medical board of the AIIMS on whether the 26-week foetus of a married woman, who is seeking permission to undergo termination of pregnancy, is suffering from any abnormality.

“Though the earlier report which has been submitted by AIIMS does mention that the foetus is normal, nonetheless, in order to place the matter beyond doubt, we request that a further report be submitted on the above aspect,” said the bench.
