Mumbai: A Mumbai court has rejected the bail application of actor Shiney Ahuja. Shiney is in judicial custody till July 16.
The prosecution has claimed in the court that has prima facie a strong case has been made against Shiney.
Court accepted prosecution's argument that if granted bail Shiney may tamper with evidence and attempt to intimidate the witness.
"Main ground for the bail was that he is a film personality and he has to go on shoots. We said that this is a case of rape. Considering all the materials the court rejected the plea. Chances of tampering of evidence could be one of the grounds for the rejection of bail plea," said Public Prosecutor RV Kinni.
The actor has been arrested for allegedly raping his domestic help.
So far DNA tests have confirmed that he had sexual relations with the 18-year-old domestic help.
Medical tests of the girl have also confirmed sexual assault.
The actor, however, has been claiming to have had consensual sex with her. He is currently lodged at the Arthur Road Jail in Mumbai.
He had applied for bail saying the rape charge against him by his maid servant was "concocted".
But Mumbai Police opposed the bail plea saying the accused might intimidate her if he is released.
The prosecution has opposed the actor's bail saying that medical and forensic reports of the accused as well as the victim had been reported positive.
"Circumstances and evidence point out that it is a case of rape and not consensual sex. The accused is an influential person and comes from the higher strata of the society while the victim was from a lower rung. He might try to tamper with evidence or might intimidate the victim," Kini had argued on Tuesday in the court.
