SC upholds Shaukat's jail term in Parliament attack case

New Delhi: The Supreme Court on Wednesday upheld the conviction of Shaukat Hussain Guru in Parliament attack case.

Earlier the trial court had given death penalty to Shaukat, which was also confirmed by the Delhi High Court.

But in its 2005 verdict the SC dropped all Prevention of Terrorism Act (POTA) charges against Shaukat and sentenced him to 10 years in prison for concealing conspiracy to attack Parliament from police.

Shaukat was, however, found guilty under Section 123 of Indian Penal Code for not informing the authorities about the plot to attack Parliament and the SC said that this was similar to waging war against the country.

Hence Sahukat was awarded a 10-year jail term.

The apex court also dismissed petition of Shaukat challenging his imprisonment in the case.

The bench headed by Justice PP Naolekar had heard Shaukat's writ petition despite dismissal of a curative plea.
